HIPAA SMS Messaging Privacy Policy

Purpose

This policy outlines the requirements and safeguards for the use of SMS/text messaging in compliance with the Health Insurance Portability and Accountability Act (HIPAA) and organizational privacy standards. The goal is to ensure that patient information remains protected and that all communications adhere to federal, state, and organizational regulations.

Scope

This policy applies to all staff, providers, and workforce members who use SMS/text messaging for communication related to patient care, operations, or business activities.

Policy Guidelines

1. HIPAA Compliance

  • SMS/text messages must not include Protected Health Information (PHI) unless transmitted through an organization-approved, HIPAA-compliant secure messaging platform.

  • Staff must avoid sharing patient identifiers (e.g., name, date of birth, medical record number) in unsecured messages.

2. Authorized Use

  • SMS/text messaging may only be used for purposes such as appointment reminders, scheduling updates, or general operational communication.

  • All communications must align with patient consent and organizational protocols.

3. Non-Sharing Clause

  • No mobile information will be shared with third parties/affiliates for marketing or promotional purposes.

  • All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Patient Consent

  • Patients must provide documented consent before receiving SMS/text communications.

  • Patients may opt out of SMS/text messaging at any time by following provided instructions.

5. Security Safeguards

  • Only organization-approved devices and applications may be used to transmit SMS/text messages containing sensitive information.

  • Staff must secure mobile devices with passwords or biometric locks and report any lost or stolen devices immediately.

6. Record Retention

  • SMS/text communications related to patient care must be documented in the medical record or an approved system of record.

  • Retention of SMS/text data will follow organizational policies and applicable laws.

7. Enforcement

  • Violations of this policy may result in disciplinary action, up to and including termination, in accordance with organizational HR policies.
